Article 1. Purpose and Scope
These General Terms and Conditions of Sale (GTC) apply to all sales of Calli-Rings products concluded online or directly with Calli-Rings, whether the buyer is a consumer or a professional. They prevail over any general terms and conditions of purchase of the customer, unless otherwise agreed in writing.
If the buyer resides in the European Union, the mandatory consumer protection provisions of their country of residence apply in addition to these GTC, where they are mandatory.
Article 2. Definitions
"Customer" means any natural or legal person placing an order with Calli-Rings. "Products" refers to all calisthenics equipment marketed by Calli-Rings. "Site" refers to the official Calli-Rings online store.
The online catalog constitutes an invitation to order, not a firm offer. The order placed by the Customer constitutes the offer, which Calli-Rings is free to accept or refuse.
Article 3. Products
Calli-Rings markets, among other things, Swiss Made calisthenics rings (manufactured in Sierre, Valais, in partnership with Workshop 4.0), 3-in-1 rings (manufactured in the Netherlands with Cutr B.V.) and parallettes (manufactured in Sierre, Valais, in partnership with Workshop 4.0).
The essential characteristics of each product (materials, dimensions, applicable warranty) are specified on the corresponding product sheet. Photographs and illustrations are indicative and are not contractual as to minor details.
Article 4. Order and Contract Formation
The sales contract is definitively formed only at the time of shipment of the order by Calli-Rings. Until then, Calli-Rings may refuse or cancel an order, particularly in the event of an obvious error in price or description, stock shortage, suspicion of fraud, or anomaly in the information provided by the Customer.
In case of cancellation by Calli-Rings before shipment, sums already paid by the Customer will be fully reimbursed, without Calli-Rings' liability being engaged beyond this reimbursement.
Article 5. Price, Taxes and Payment
Prices are indicated in Swiss francs (CHF), all taxes included, including Swiss VAT at the legal rate in force at the time of the order.
Professionals settle their order according to the terms agreed with Calli-Rings, failing that within 30 net days. Consumers pay for their order in full at the time of order.
Any delay in payment will automatically result in interest at the legal Swiss rate, as well as reimbursement of collection costs reasonably incurred by Calli-Rings.
Article 6. Delivery
|
DAP: DELIVERED AT PLACE, DUTIES AT DESTINATION Calli-Rings delivers its products worldwide under the Incoterm DAP (Delivered At Place). The price paid by the Customer upon order covers transport to the agreed place of delivery. Customs duties, import taxes, and customs clearance fees applicable in the destination country remain the responsibility of the Customer and are payable at the time of delivery or customs clearance, according to locally prevailing rules. The Customer is informed of this distribution before finalizing their order. |
The indicated delivery times are given for information purposes only. A reasonable delay cannot lead to cancellation or compensation, unless the delay is attributable to a fault of Calli-Rings and after an unsuccessful formal notice.
The transfer of risks occurs upon receipt of the products by the Customer.
Article 7. Force Majeure
Calli-Rings is released from its obligations in the event of a force majeure event beyond its reasonable control: natural disaster, strike, war, epidemic, computer failure or cyberattack affecting its systems or those of its service providers, border closure, supply disruption at a supplier, or unforeseen government measure.
Calli-Rings informs the Customer as soon as possible. The obligations concerned are suspended; if the situation persists unreasonably, each party may terminate the order without compensation.
Article 8. Legal Warranty
Calli-Rings guarantees its products against defects in accordance with Swiss law. The Customer is invited to inspect the products upon receipt and to report any apparent defect within a reasonable period, in order to preserve their rights.
Article 9. Calli-Rings Commercial Warranty
In addition to the legal warranty, Calli-Rings offers a commercial warranty against manufacturing defects:
-
10 years for rings (Swiss Made and 3-in-1)
-
5 years for parallettes
-
2 years for straps and Calli-Straps, which is the legal minimum in Switzerland, with no commercial extension beyond this
These durations run from the date of purchase. This warranty is detailed in the warranty and returns policy available on the website, which prevails over any contrary provision not included herein. It does not cover normal wear and tear or improper use of the product, and becomes void in case of unauthorized modification.
Recourse in case of valid claim
During the first 2 years following purchase (legal warranty), the Customer freely chooses among the remedies provided by applicable law.
From the 3rd year until the end of the applicable commercial warranty, any valid claim requires photographic or video proof of the problem as well as prior written approval from Calli-Rings, anywhere, including in Switzerland and the European Union. Once approved, Calli-Rings applies the following order of recourse: exchange as a priority; failing that, a credit usable on the online store; failing that, a refund.
Refund and Credit Amounts
-
during the first 2 years: full refund or credit of the price paid, minus return shipping costs
-
from the 3rd year: refund or credit capped at 50% of the price paid, adjusted downwards depending on the condition of the returned product, minus return shipping costs
Return shipping costs are borne by the Customer in all cases. Exchange is still offered without this reduction for the entire duration of the applicable commercial warranty.
Article 10. Equipment Use and Safety Instructions
Calisthenics is a physical activity involving inherent risks, including a risk of serious injury due to improper use. By using Calli-Rings products, the Customer acknowledges having received or consulted the installation and use instructions, and agrees to:
-
inspect the equipment and its anchoring point before each use
-
comply with Calli-Rings' published load recommendations and exercise increased caution during dynamic or explosive movements (kip, transitions, jumps)
-
immediately cease use if there are any signs of wear, cracks, or deformation
-
not modify the product in any way
-
only use the product on a stable and suitable anchoring structure
-
ensure adult supervision for any use by a minor
|
MAXIMUM LOAD, CERTIFICATION IN PROGRESS Pending final certification of maximum load by an accredited body, the user is required to consult the usage recommendations published on the Calli-Rings website before each use, and to exercise increased caution during dynamic or explosive movements. Calli-Rings reserves the right to publish or modify any load recommendation as certifications progress. |
Calli-Rings disclaims all liability for the consequences of non-compliance with these instructions.
Article 11. Liability
Calli-Rings' liability for any indirect, incidental or consequential damages (loss of profit, loss of data, moral damage in particular) is excluded to the fullest extent permitted by Swiss law.
For any other damage, Calli-Rings' liability is limited to the price actually paid by the Customer for the product(s) concerned.
This limitation does not apply in cases of fraud, gross negligence, or harm to life or physical integrity, for which Calli-Rings' liability remains full and complete in accordance with Swiss law.
Calli-Rings does not guarantee any sporting results, physical progress or health benefits related to the use of its products.
Article 12. Returns and Claims
Between professionals, no right of return is guaranteed for anything other than a non-compliant or defective product, unless otherwise agreed.
For consumers, the return window applicable to the order (distinct from the warranty described in Article 9) depends on the delivery location, subject to the eligibility conditions below:
-
Switzerland: 30 days after receipt, no prior approval required
-
European Union and rest of the world: 14 days after receipt, no prior approval required; for residents of the European Union, this period corresponds to the legal right of withdrawal, which cannot be subject to approval
To be eligible, in all cases, the item must:
-
not have been used and be in the same condition as at receipt
-
be returned in its original packaging
-
include all accessories and documentation
-
be accompanied by the receipt or proof of purchase
Return costs are borne by the Customer in all cases, including for approved warranty claims, in accordance with Article 9.
These rights are exercised under the conditions provided by Calli-Rings' return policy, available on the website.
Article 13. Intellectual and Industrial Property
Calli-Rings holds the intellectual and industrial property rights attached to its products, brands, logos, designs, content, photographs, manuals and models, notably international design registration OMPI no. DM/235803.
The sale of a product does not confer on the Customer any right of use, reproduction or exploitation of these elements, other than the personal use of the acquired product.
Article 14. Product Compliance and Regulatory Safety
Calli-Rings rings and parallettes are static calisthenics equipment, without electrical, electronic or motorized devices.
Within the European Union, they fall under the general product safety regime and are designed in compliance with the European standard applicable to suspended gymnastics rings. This is not a product category subject to CE marking, as CE marking is reserved for other product categories according to applicable European regulations.
Article 15. Data Protection
Calli-Rings processes the Customer's personal data strictly as necessary for the execution of the order and in accordance with its privacy policy, available on the website.
Article 16. Applicable Law and Jurisdiction
These GTC are governed by Swiss law. Any dispute falls under the exclusive jurisdiction of the courts of the canton of Geneva, subject to the mandatory consumer protection provisions applicable in the Customer's place of residence, where they apply.
Article 17. Final Provisions
If any clause of these GTC should be deemed invalid, the other clauses shall remain fully applicable.
Any amendment to these GTC requires a written agreement between the parties. The GTC are drafted in French; in case of translation, the French version prevails. The Customer may not assign its rights and obligations under the contract without the prior written consent of Calli-Rings.
